The California Civil Code under Section 1102 (CAL. CIV. \u00a71102.3) requires that every residential seller complete a TDS for the buyer. This document is one of the seller disclosures buyers receive during their contract contingency period.&nbsp; <\/p>\n\n\n\n<p>TDS is one of the most complex disclosures in California. This form is similar to most seller disclosures. Further, a disclosure statement is used as evidence in lawsuits. And given how comprehensive the document is, it should be carefully handled.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"sections\"><strong>Different sections in the California Real Estate Transfer Disclosure Statement<\/strong><\/h2>\n\n\n\n<p>The TDS has 5 sections:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Coordination with Other Disclosure Forms<\/li>\n\n\n\n<li>Seller\u2019s Information<\/li>\n\n\n\n<li>Agent&#8217;s Inspection Disclosure &#8211; For Seller<\/li>\n\n\n\n<li>Agent&#8217;s Inspection Disclosure &#8211; For Agent<\/li>\n\n\n\n<li>Additional Professional Advice and\/or Inspections<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"coordination-forms\"><strong>Coordination with Other Disclosure Forms<\/strong><\/h2>\n\n\n\n<p>The RETDS must be disclosed with the other disclosures required by the state of California. The seller fills in section 2 of the Real Estate Transfer Disclosure. The seller must provide any inspection reports with pertinent information.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Seller\u2019s Information<\/strong><\/h2>\n\n\n\n<p>The seller has to cover items on the subject property that the seller is aware of. Therefore having actual knowledge of available appliances, leaky roof to whether any deaths occurred on the property in the last three years. <\/p>\n\n\n\n<p>This form is not a warranty, but it is a reliable source of information for the buyer. Hence this shows the seller has disclosed all items not in operating condition. Further, it is classified into sub-sections: <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>A)<\/strong> <strong>Occupancy:<\/strong> <\/h4>\n\n\n\n<p>Sellers should indicate whether they are presently living in the property. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>B) Section A:<\/strong><\/h4>\n\n\n\n<p> Appliances Systems and Other Items: Here the sellers disclose:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All the appliances like kitchen range, dishwasher, central heating\/air conditioning, sprinklers, and hot tub.<\/li>\n\n\n\n<li>All electricity, gas, and water supply details.<\/li>\n\n\n\n<li>Any chemicals on the property \u2014 for example, if marijuana or methamphetamine was grown there.<\/li>\n\n\n\n<li>Major neighborhood disturbances such as rush-hour traffic or adjacency to an airport.<\/li>\n\n\n\n<li>Any encroachments, easements, or other issues affecting a seller\u2019s interest in the property.<\/li>\n\n\n\n<li>Any common area\u2014such as a pool or walkway\u2014co-owned in undivided interest with others.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>C) Section B:<\/strong>  <\/h4>\n\n\n\n<p>Defects\/Malfunctions  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Although this cuts down on a seller attempting to cover up the home\u2019s defects. However, your listing agent should complete the agent&#8217;s inspection disclosure. Hence, a buyer&#8217;s agent will complete a separate section.<br><br>Under no circumstance should an agent ever check the box that says there are no items for disclosure.
